A commuter from the Steenvoorde district drives daily via the A13 to his work in Den Haag. Following a minor collision at exit 7, his claim is reported, resulting in a CIS registration that blocks every new motor policy years later. Such cases occur more frequently than expected in the Haaglanden suburban municipalities.
Contents of the CIS register
The CIS contains three categories of information:
1. External Referral Register (EVR)
The most serious category. It lists individuals and companies where fraud has been established or is strongly suspected. Registration for up to 8 years is possible. Insurers with access routinely refuse new policies to persons listed in the EVR.
2. Incidents Register
A lighter category: claims where an increased risk has been identified, but no fraud proven. Registration typically lasts 5 years.
3. Risk Register
General data on elevated claims risk — for example prior claims or residence in a high-risk neighbourhood. Not necessarily fraud-related.
Access for insurers in the Netherlands
Virtually all Dutch health, non-life, life and disability insurers participate in the CIS. Every new policy application is automatically checked against the CIS. A hit almost invariably leads to refusal or acceptance on aggravated terms.
Consequences for residents of Rijswijk
- Refused policy applications with virtually every participating insurer
- Higher premiums where acceptance is granted
- No mortgage if the required buildings insurance cannot be obtained
- Termination of existing policies in certain cases
- Impact on credit applications when banks also consult financial databases
For commuters using the A4 or A12 daily, a refused motor policy frequently causes immediate problems with travel to work.
Requesting access
You have the right of access under the AVG (Article 15). Send a written request to:
Stichting CIS
Antwoordnummer 4860
3500 ZL Utrecht
You must identify yourself with a certified copy of your ID. Within one month you will receive an overview of your registration(s). Access is free.
Removal procedure
Four-step procedure:
Step 1: request the file from the insurer
Request the complete fraud file from the insurer that registered you. It must demonstrate the grounds on which the registration is based.
Step 2: submit a written objection
Send a reasoned objection containing:
- Explanation why the registration is unjustified
- Supporting evidence (alibi, counter-reports, witness statements)
- Request for removal from the CIS
The insurer must respond within four weeks.
Step 3: Kifid or complaints body
If the decision is unfavourable: proceed to Kifid. There you may also object to the registration itself, not merely to the claims handling. Processing time 6–12 months, complaint fee € 50.
Step 4: civil court
For complex matters or substantial damage: interim proceedings before the Rechtbank Den Haag for immediate removal, or a full action for damages.
Damages for unjustified registration
The Hoge Raad has confirmed that an insurer that has unjustifiably entered a fraud registration is liable for the resulting damage — missed policy opportunities, higher premiums elsewhere, legal costs. Amounts range from several thousand to tens of thousands of euros depending on duration and consequences.
Important time limits
- Limitation period: 5 years from the moment the registration became known (Article 3:310 BW)
- Maximum EVR registration period: 8 years; automatic removal thereafter
- Kifid complaint period: within 1 year after written rejection of your objection
Practical advice
Have you ever had a policy refused without a clear reason? Request CIS access immediately. Many people discover only years later that they have been registered without fault — due to an error or a one-sided assessment by an insurer. Early correction prevents years of financial restriction.
